Subject: CONVICTION WARRANT IN SESSIONS CASE NO: 191 OF 2021, STATE VERSUS NIAZ HUSSAIN BROHI & OTHERS U/S; 302, 311, 114, 148, 149, 504, 337HII, AI,FI,LII PPC IN CRIME NO: 51/2020 POLICE STATION GUPCHANI.
Whereas today i.e. 06th day of May, 2026, this Court has convicted accused Niaz Hussain u/s 265 H(2) C.r.P.C. and sentenced to suffer imprisonment for life u/s 302 (b) PPC R/w Section 311 PPC as Tazir. He is also directed to pay Rs.2,00,000/- (Rupees Two Lac) as compensation of the LRs of the deceased U/s 544-A Cr. P.C. In case of failure in payment of compensation amount, he will have to suffer S.I. for six months more. The compensation if unpaid shall be recoverable as arrears of land revenue. Accused persons Shah Murad and Dil Murad are convicted u/s 265 H(2) C.r.P.C for the offence u/s 302 (c) PPC and sentenced to suffer R.I for ten years each. They are further convicted for the offence punishable U/s 337-A(i), F(i) PPC each accused to suffer R.I. for one year and also to pay Rs. 50,000/- to injured namely Shah Muhammad by each of the accused/convict as damn. Further the accused Niaz Hussain, Shah Murad and Dil Murad also convicted for the offence U/s 148 PPC to suffer R.I. for 03 years by each accused and to pay fine Rs. 10,000/- each. In default, they will have to suffer S.I. for two months. Record shows that accused Niaz Hussain remained in jail being the UTPs w.e.f. 28.10.2020, while accused Shah Murad remained in jail being the UTP w.e.f. 28.10.2020 to 07.02.2023, while accused Dil Murad remained in jail being the UTP w.e.f. 24.04.2020, hence, benefit of section 382-B Cr.P.C is extended to them.
2. The accused Niaz Hussain and Dil Murad have been produced in custody from District Prison, Shaheed Benazirabad, and are remanded back to serve out the above sentences awarded to them. Accused Shah Murad is present on bail, hence, he is taken into custody and sent to jail to serve out the above sentences.
3. The Superintendent Central Prison and Correctional Facility, Shaheed Benazirabad is directed to return the conviction warrant to this court with an endorsement under his hand certifying the manner in which the sentence has been executed.
