SUBJECT: RELEASE WRIT OF ACCUSED/CONVICTEE DIL NAWAZ S/O MUHAMMAD IBRAHIM KHASKHELI AND MUHAMMAD NAWAZ S/O MUHAMMAD IBRAHIM KHASKHELI IN CR. APPEL NO. 11/2024 DIL NAWAZ & ANOTHER VERSUS THE STATE, U/S: 5-8(I) OF SPPMSS & UGMA 2019 & 353, 34 PPC, CRIME NO. 306//2022, OF P.S: SHAHDADPUR.
Whereas, the above named accused was convicted vide judgment dated: 31.07.2024 passed by the court of Learned Civil Judge & JM-II, Shahdadpur, wherein, accused/convictee namely Dil Nawaz & Muhammad Nawaz, both S/O Muhammad Ibrahim were convicted and sentenced U/S 245(ii) CR.P.C and awarded imprisonment for a term of one Year and fine of amount Rs.1,00,000/-, in case of default thereof, they shall serve for 03 more months S.I.
However, advocate for accused filed Crimial Appeal along with application U/S: 426 Cr.P.C against the judgment dated: 31.07.2024 passed by Learned Civil Judge & JM-II, Shahdadpur. Whereas, application U/S: 426 Cr.P.C has been allowed by this court subject to surety in the sum of Rs.50,000/- for each and same has been furnished by accused/convictee.
You are therefore, directed to release the above named accused/Convictee Dil Nawaz S/O Muhammad Ibrahim and Muhammad Nawaz and Muhammad Ibrahim, both by caste Khaskheli in the above mentioned case/crime, forthwith, if they they are not required in any other custody case and crime by any other Court. The P.R bonds of accused is enclosed herewith and same be returned to this court after obtaining the signature/ LTI of accused on it.
