RELEASE ORDER

                WHEREAS, in the above noted matter, advocate for appellant/ accused named filed criminal appeal against conviction under Section 408 Cr.P.C. vide judgment dated. 30-11-2024 passed by the learned XVIth Assistant Sessions Judge Karachi West, in Cr. case No. 950/2024, whereby appellant/ accused convicted under Section 245-(ii) of CRPC, in offences under Section 23(I) A, SAA 2013, and sentenced him to suffer simple imprisonment for two (2) years and fine of amount of Rs. 50,000/-, and for none payment of which he has to sufere simple imprisonment for 15 days, more in the judicial custody. The period has been already spend in the jail custody shall be treated as undergone after commutation u/s 382-B. Today the matter fixed for judgment. Heard arguments from learned counsel for appellant /accused, and learned DDPP for state. Therefore, the appeal in hand is allowed and impugned judgment dated: 30.11.2024 passed by the learned XVIth Assistant Sessions Judge Karachi West, is set aside, and appellant/accused acquitted from the charge. Appellant /accused is in custody. You are hereby directed to release the appellant /accused namely Bilal s/o Ghulam Rasool, forthwith, if he is no more required in any other custody matter, under intimation to this court.
