Whereas the above named appellant/accused has filed Criminal Appeal U/S 408 Cr. PC against the sentence awarded by the Court of Civil Judge & Judicial Magistrate, Chachro in Criminal Case No.16/2025 (Re-The state versus Manzoor Ali and another) whereby appellants/accused 01.Manzoor Ali son of Mitho alias Manthar, Adult Muslim, by caste Rahimoon, Resident of Village Lehrka, Taluka Chachro, District Tharparkar and 02. Azizullah son of Siraj-ul-din, Adult Muslim, by caste Rahimoon, Resident of Village Tardos, Taluka Chachro, District Tharparkar have been convicted and sentenced under Section 245-(i) Cr.P.C and they have been taken into custody & remanded to Central Prision & Correctional Facility Mirpurkhas vide Judgment dated 20.05.2025 passed in above mentioned criminal case. Appellants/accused also moved an application U/S 426 Cr. PC for suspension of sentence mentioned above along with the said appeal.
And whereas, this Court after hearing of the learned counsel for the parties and learned ADPP for the state, allowed the application U/S 426 Cr. PC and suspended the sentence mentioned above subject to furnishing the surety in the sum of Rs.1,000,00/- (Rupees One Lac) with P.R bond in the like amount to the satisfaction of this Court.
And whereas, the appellants/accused furnished required surety before this Court in the sum of Rs.1,000,00/- (Rupees One Lac) with P.R bond in the like amount to the satisfaction of this Court.
You are, therefore, hereby directed and authorized to release the above named accused forthwith, if they are not required in any other custody case with direction to the appellants/accused to appear before this Court on 16.06.2025 at 08:30 a.m., when the above mentioned criminal appeal is fixed for final arguments.
