Whereas, in the above mentioned criminal case, accused 01. SRI CHAND S/O. WARAND MALL BY CASTE HINDU is convicted U/S: 265-H (ii) Cr.P.C and learned trial court considered the fact that accused/appellant is first time offender and sentenced awarded by learned trial Court is balanced one; therefore, I see no need to modify the sentence, awarded by learned trial court. Sentence of accused of one year simple imprisonment, along with payment of fine of Rs.10.000/- is maintained. In case of default in payment of fine the appellant/accused shall undergo simple imprisonment for one month, as held by learned trial court. Benefit of Section 382-B Cr.PC will be availed by accused, as per law. Appellant/accused is present on bail before the court. He is taken into custody and remanded to jail to serve out the remaining sentence..
