SUBJECT:   RELEASE OF ACCUSED ZAHID GAHO.

                Whereas, accused Zahid s/o Momin, Gaho is confined in your jail custody in connection with the above titled case pending trial before this Court.

                And whereas, learned DDPP for the State was put on notice under Section 265-K Cr.PC as to why the accused may not be acquitted from the charges of this case. In response to such notice, learned DDPP for the State submitted that it would be appropriate to record evidence in this case after framing proper charge against the accused.  I am not agree with suggestion of learned DDPP for the State as in case the charge is framed against the accused and evidence is recorded, it will not improve the prosecution case as setup in FIR. There is nothing available on record to connect the accused in commission of this offence. The Police file shows that there no any other evidence collected during investigation against the accused, therefore, accused is acquitted from the charge of this case u/Section 265-K Cr.PC.

                You are hereby directed to release above said accused  Zahid s/o Momin, Gaho forthwith if he is not required in any other custody case.
