Whereas the accused Zaheer s/o Wazir, by caste Mahar is acquitted of the charge U/S 345(6) Cr.P.C in terms of compromise subject to payment of diyat amount owed to the minors of deceased to the extent of their share of diyat amount Rs. 3,191,231.50/- to son of deceased Barkat, namely Salamat Ali and Rs. 1,595,615.75/- to the daughter of deceased Barkat, namely Aliza total amounting Rs. 4786847.25/- in view of the principle laid down in the case reported as PLD 2003 Karachi 277 (Muhammad Sharif V/S The State).
You are, hereby, directed and authorized to RELEASE the above said accused after payment of diyat amount to the minor legal heirs of deceased with this office/Accountant of Sessions Court Shikarpur, who shall invest the same in most profitable scheme of Government till attaining the age of major by minor legal heirs of the deceased.
