SUBJECT: RELEASE INTIMATION OF ACCUSED IN CRIMINAL APPEAL NO. D-23/2023 REGARDING GHULAM NABI SHAR U/S 9 (C) CONTROL OF NARCOTIC SUBSTANCES AMENDED ACT 2022 CRIME NO. 65/2021 OF P.S MADEJI.
WHEREAS, this Court convicted and sentenced accused Ghulam Nabi S/O Rehmatullah by caste Jatoi under section 9 (C) Control of Narcotic Substances Act 1997 for the period he already remained inside prison (sentence treated as undergone) and fine of RS.10,00,000/-/- (RS. One Million) and in case of failure to pay fine he will undergo S.I for ten years, vide Judgment dated 22.03.2024. The accused Ghulam Nabi S/O Rehmatullah by caste Jatoi preferred appeal before Honourable High Court of Sindh, Circuit Court Larkana. The Honourable High Court of Sindh, Circuit Court Larkana has been pleased to pass Judgment dated 22.05.2024 in Criminal Appeal No. D-23 of 2024, with observation that “The sentence to the extent of fine of Rs. One Million and in default whereof simple imprisonment for ten years inflicted upon appellant by trial court vide impugned judgment dated 22.03.2024, is hereby reduced to Rs. 50,000/- (Fifty thousand rupes) and in default in payment of such fine, the appellant to undego S.I for one month.” and directions have been issued to this Court to release accused after payment of fine amount of Rs. 50,000/- (Fifty thousand rupees). The said fine amount has been deposited by the accused on 28.06.2024.
YOU ARE, therefore, directed/authorized to release the above named accused from your custody forthwith, if he is no more required in any other custody case/crime.
