SUBJECT: RELEASE INTIMATION OF ACCUSED IN JAIL CRIMINAL APPEAL NO. 01-I OF 2024 ST.VS. HADI BUX AND ORS U/S: 17/4, OFFENCES AGAINST PROPERTY (ENFORCEMENT OF HUDOOD) ORDINANCE 1979, 337-H2,148,149, PPC CRIME NO. 03/2014 PS 20 MILES
WHEREAS, this Court convicted and sentenced accused 1. Mazno @ Ghulam s/o Ramzan and 2. Talib s/o Sallah all by caste Mangnejo, under section 17/4, OFFENCES AGAINST PROPERTY (ENFORCEMENT OF HUDOOD) ORDINANCE 1979, 337-H2,148,149, PPC for offence punishable under section 17/4, OFFENCES AGAINST PROPERTY (ENFORCEMENT OF HUDOOD) ORDINANCE 1979, 337-H2,148,149, PPC, they are convicted U/S 265-H(ii) Cr.P.C under Tazir and sentenced as follows.
1. The accused Mazno @ Ghulam and Talib are convicted for offence punishable u/s 396 P.P.C and sentenced to imprisonment for life and to pay fine of Rs. 2,00,000/- (Rupees two lac) each and in case of failure thereto, both shall suffer six months S.I more. Both the accused shall also pay compensation of Rs. 5,00,000/= (Rupees five lac) each to the legal heirs of the deceased and in case of failure thereto, they shall suffer further SI for one year more.
2. The accused Mazno @ Ghulam and Talib are also convicted for offence punishable u/s 337-H(ii) PPC and sentenced to undergo SI for three months and to pay fine of Rs. 20,000/= (Rupees twenty thousand) each and in case of failure, thereto, they shall suffer further SI for one month more.
The accused Mazno @ Ghulam s/o Ramzan and 2. Talib s/o Sallah all by caste Mangnejo, preferred appeal before Honourable Federal Shariat Court of Pakistan. The Honourable Federal Shariat Court of Pakistan has been pleased to pass Judgment that, the conviction and sentence awarded to the appellants namely 1. Talib son of Sallah 2. Mazno @ Ghulam both now confined in Central Prison Sukkur in the above noted case impugned judgment dated. 05.12.2023, has been set aside and appellatns / convicts Talib and Mazno alias Ghulam are acquitted from the charge and released forthwith, if not required an any other case. The Judgment dated. 09.05.2025, in criminal jail appeal No. 01-I of 2024.
YOU ARE, therefore, directed/authorized to release the above named accused from your custody forthwith, if he is no more required in any other custody case/crime.
