WHEREAS: the advocate for the above named appellant/Convict has filed application u/s 426 Cr.P.C requesting therein to release the appellant/Convict on bail in Criminal Appeal No.01/2024, Ratan …..Versus.... The State, in Criminal Case No.117 of 2023, Re-The State … Versus… Ratan, involved in crime No.45/2023, U/A 3 and 4 P.E.H.O 1979 of P.S Kaloi and sentenced him 15 months (SI) and to pay fine of Rs. 5000/- in case of default, he shall further remain in prison for one-month. The benefit of section 382-B Cr.P.C was also provided to him by the trial Court of Civil Judge & Judicial Magistrate, Diplo, vide Judgment dated 02-01-2024 and this Court after hearing the advocate for appellant/convict and A.D.P.P for the state suspends the Judgment of the trial Court and appellant/convict be released on bail subject to furnishing a solvent surety in the sum of Rs.10,000/- (Rupees Ten Thousand) with P.R bond in the like amount to the satisfaction of this Court vide order dated 09-01-2024.
And whereas the above named appellant/convict has furnished the required surety in the sum of Rs. 10,000/- (Rupees Ten Thousand) with P.R bond in the like amount to the satisfaction of this Court.
You are, therefore, directed and authorized to release the above named appellant/convict forthwith, if he is not required in any other custody case by any other Court, after causing their P.R bond in the sum of Rs.10,000/- (Rupees Ten Thousand) with direction to appear before this Court on 18-01-2024 at 8:30 A.M without fail and return the release writ with endorsement on the foot of it after causing his P.R bond within two days to this Court for record.
