WHEREAS, on this 23rd February, 2026 the accused Wazeer s/o Ali Gul Jatoi is convicted under section 265 H(ii) Cr.P.C for offence under section 302 (b) read with section 149 PPC and he is sentenced to death as Ta’zir. The accused shall be hanged by the neck till he is dead. Accused is further directed to pay compensation to the legal heirs of deceased to the sum of Rs.10,00,000/- accused (Rupees Ten Lacs only accused) under section 544-A Cr.P.C, to the legal heirs of deceased and in case of default he shall suffer SI for 06 months more. He is also extended benefit of section 382-B Cr.P.C for the period remained imprisoned. Accused Riaz @ Mehboob s/o Ali Nawaz Jatoi is also found guilty and by taking lenient view regarding his role in commission of offence, he is convicted under section 265-H(ii) Cr.P.C for offence under section 302 (b) PPC r/w section 149 PPC and sentenced to undergo life imprisonment. Accused is further directed to pay compensation to the legal heirs of deceased to the sum of Rs.3,00,000/- accused (Rupees Three Lacs only accused) under section 544-A Cr.P.C. to the legal heirs of the deceased. He is also extended benefit of section 382-B Cr.P.C for the period remained imprisoned and in case of default he shall suffer SI for 06 months more. Accused Riaz @ Mehboob is sentenced lesser punishment for the reasons that his role is lesser in participation of commission of offence. The firing of accused did not sustain to the deceased directly and has no role of direct firing upon deceased, however his actively presence is proved. Accused Riaz @ Mehboob s/o Ali Nawaz Jatoi is also found guilty for offence under section 337 H(ii) PPC and convicted accordingly. He is sentenced to RI for one year and fine of Rs.5000/only. And in case of default he shall suffer SI for one month only. Both above named accused are also convicted for offence under section 148 PPC and sentenced to undergo simple imprisonment for the period of two years and to pay fine of Rs.5000/each accused and in case of default of payment of fine amount they shall suffer one month SI. Accused Riaz @ Mehboob s/o Ali Nawaz Jatoi is present on bail. He is taken into custody and remanded to prison to serve out sentence as per law.
This is to authorize and require to you the District Jail, Khairpur to receive the writ of conviction in your safe custody for compliance of said judgment and carry the aforesaid sentence into execution according to law.
