WHEREAS: the advocate for the above named appellants/Convictee has filed application u/s 426 Cr.P.C requesting therein to release the appellants/Convictee on bail in Criminal Appeal No.02/2024, Mir Khan & others…..Versus.... The State, in Criminal Case No.77 of 2023, Re-The State … Versus… Mehboob Ali & others, involved in crime No.47/2023, U/S 379, 215, 34 PPC of P.S Nangarparkar and convicted them for the offence punishable under section 379, 34 PPC and sentenced them R.I for 2 years and to pay fine of Rs: 10,000/- (Ten Thousand Rupees) to be paid by each convict, in case of default thereof they shall further undergo S.I for 2 months each. The benefit of section 382-B Cr.P.C also extended to all convicts and this Court after hearing the advocate for appellants/convictee and A.D.P.P for the state suspends the Judgment of the trial Court and appellants/convictee be released on bail subject to furnishing a solvent surety in the sum of Rs.20,000/- (Rupees Twenty Thousand) each with P.R bond in the like amount to the satisfaction of this Court vide order dated 17-01-2024.
And whereas the above named appellants/convictee have furnished the required surety in the sum of Rs.20,000/- (Rupees Twenty Thousand) each with P.R bond in the like amount to the satisfaction of this Court.
You are, therefore, directed and authorized to release the above named appellants/convictee forthwith, if they are not required in any other custody case by any other Court, after causing their P.R bond in the sum of Rs.20,000/- (Rupees Twenty Thousand) each with direction to appear before this Court on 30-01-2024 at 8:30 A.M without fail and return the release writ with endorsement on the foot of it after causing their P.R bond within two days to this Court for record.
