Whereas the above named appellants/accused have filed Criminal Appeal U/S 408 Cr. PC against the sentence awarded by the Court of Civil Judge & Judicial Magistrate-II, Mithi in Criminal Case No.64/2025 (Re-The state versus Hayat and others) vide Judgment dated 27.03.2026 passed in above mentioned criminal case. Appellants/accused also moved an application U/S 426 Cr. PC for suspension of sentence mentioned above along with the said appeal.
And whereas, this Court after hearing of the learned counsel for the parties and learned ADPP for the state, allowed the application U/S 426 Cr. PC and suspended the sentence mentioned above subject to furnishing the surety in the sum of Rs. 50,000,/- (Rupees Fifty Thousand) each with P.R bond in the like amount to the satisfaction of this Court.
And whereas, the appellants/accused furnished required surety before this Court in the sum of Rs. 50,000,/- (Rupees Fifty Thousand) each with P.R bond in the like amount to the satisfaction of this Court.
You are, therefore, hereby directed and authorized to release the above named accused forthwith, if they are not required in any other custody case with direction to the appellants/accused to appear before this Court on 21.04.2026 at 08:30 a.m., when the above mentioned criminal appeal is fixed for final arguments.
